1. Who we are and what this is

Balum ("Balum", the "App", "we", "us", or "our") is a personal Islamic wellbeing companion that offers prayer times, Qiblah direction, daily reflections, learning content, habit and streak tracking, a mood check-in, guided breathing, a private journal, and a private du'a record.

These Terms & Conditions ("Terms") form a binding agreement between you ("you" or the "user") and Balum, the provider of the App. By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

You must be at least 13 years old (or the minimum digital-consent age in your country) to use the App.

2. The Balum service

The App is provided to you under a limited, personal, non-exclusive, non-transferable, revocable licence for your own non-commercial use, subject to these Terms and to the App Store terms in Section 13.

We may add, change, suspend, or remove features at any time. The App is free to use, with no advertising and no subscriptions. We may in future offer optional one-time in-app purchases (for example a cosmetic theme). If we do, the price is the one shown by the App Store or Google Play before you buy, payment and refunds are handled by them under their terms, and a purchase can be restored on a new device from within the App. Everything the App offers today is free.

3. Accounts and sign-in

Balum works without an account. Most data stays on your device (see Section 4).

You may optionally sign in with Google or Apple, or with an email "magic link" to back up and sync your progress across devices. If you do, we receive from your chosen sign-in provider and store your name and email address (with the email magic-link option, just your email address; with Sign in with Apple you may choose to hide your email), together with the progress data described below, on our hosting provider (Supabase). When you sign in by email magic-link, we use Resend to deliver the one-time sign-in email. You are responsible for keeping access to your chosen sign-in account secure. You can stop syncing at any time by signing out, and you can delete your account and synced data at any time (see Section 5).

4. Your data and privacy

We are privacy-first by design. Specifically:

Stored only on your device (never uploaded): your journal entries and private du'a records, your own words, personal reminders and mood check-ins, and your language and preferences. Your device's own backup (iCloud or Google) may include them if you have backups on.
Your location is used on your device to calculate prayer times and the Qiblah; to show your city's name it is looked up with a mapping service, without any account or identifier.
Synced to the cloud only if you choose to sign in: your name and email (from your sign-in provider), and your progress data: streaks, points/XP, badges, daily completions, and your saved bookmarks.
Anonymous, aggregate usage analytics (on by default, can be turned off) and crash reporting help us improve the App and fix problems. Neither is used to identify you.
We do not sell your personal data. To measure our own ads, the App tells Meta when it is installed and opened, as described in the Privacy Policy; nothing you do in the App is shared.

If you enable push notifications, we use the information necessary to deliver reminders (e.g. prayer-time and journey reminders). You can disable notifications at any time in your device settings.

5. Deleting your data

You may delete the data stored on your device by removing the App. If you have signed in, you can delete your account and all cloud-stored account data (name, email, progress, bookmarks) at any time from within the App (open your profile, then "Delete account"), or by contacting us at [email protected], in which case we will delete it within a reasonable period unless we are required to retain it by law.

6. Religious and informational content: important disclaimer

Balum is a personal aid, not a religious authority.

Prayer times and Qiblah direction are calculated from your location using standard astronomical and calculation methods. They are estimates and may differ from your local mosque or community. Always verify with a trusted local source for matters of worship.
Quran text, translations, hadith, supplications, lessons, and other content are provided for general educational and devotional purposes and may contain errors, omissions, or simplifications. They are not a substitute for qualified scholarly guidance.
Wellbeing features (mood check-in, breathing, journaling, reflections) are for general self-care and reflection only. They are not medical, psychological, or mental-health advice, diagnosis, or treatment. If you are struggling, please seek a qualified professional. In an emergency, contact your local emergency services.

7. Acceptable use

You agree not to: (a) use the App for any unlawful purpose; (b) copy, modify, reverse-engineer, decompile, or create derivative works of the App except as permitted by law; (c) attempt to gain unauthorised access to our systems or other users' data; (d) interfere with or disrupt the App or its infrastructure; or (e) remove or obscure any proprietary notices.

8. Intellectual property

The App, its design, code, original text, graphics, and branding (including the name "Balum") are owned by us or our licensors and are protected by intellectual-property laws. Third-party content (such as scripture text, translations, and fonts) remains the property of its respective owners and may be subject to its own licences. Except for the limited licence in Section 2, no rights are granted to you.

9. Third-party services

The App relies on third-party services, including Google and Apple (optional sign-in), Meta (measuring our own ads), Resend (delivering the email sign-in "magic link"), Supabase (hosting and storage), Sentry (crash and error reporting), Capgo (over-the-air app updates), Photon (komoot) and OpenStreetMap (location lookups), public content services for Qur'an text and audio, and RevenueCat (optional in-app purchases, if and when offered). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services or content.

10. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any content (including prayer times) is accurate or complete.

11. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the App. Because the App is free, our total aggregate liability for any claim relating to the App will not exceed USD 50. Nothing in these Terms excludes liability that cannot be excluded by law.

12. Indemnity

You agree to indemnify and hold us harmless from any claims, losses, or expenses arising from your misuse of the App or your breach of these Terms.

13. Apple App Store: Additional Terms (EULA)

These additional terms apply to your use of the App obtained through the Apple App Store and form part of these Terms. In the event of a conflict, this Section 13 prevails for App Store downloads.

Acknowledgement. These Terms are concluded between you and us only, and not with Apple. Apple is not responsible for the App or its content.
Scope of licence. The licence granted to you is limited to a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the App Store Usage Rules in the Apple Media Services Terms and Conditions.
Maintenance and support. We, not Apple, are solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the App.
Product claims. We, not Apple, are responsible for addressing any claims by you or a third party relating to the App or your use of it, including: (i) product-liability claims; (ii) any claim that the App fails to conform to applicable legal or regulatory requirements; and (iii) claims arising under consumer-protection, privacy, or similar legislation.
Intellectual-property claims. In the event of any third-party claim that the App or your use of it infringes that third party's intellectual-property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of any such claim.
Legal compliance. You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country, and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-party beneficiary. You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the App. Your continued use after changes take effect means you accept the updated Terms.

15. Termination

These Terms apply until terminated. We may suspend or terminate your access if you breach them. You may stop using the App at any time by deleting it. Sections that by their nature should survive termination (including Sections 8 to 12) will survive.

16. Governing law

These Terms are governed by applicable law. Nothing in these Terms affects mandatory consumer-protection rights you may have in your country of residence.
